Bourne Noll &
Kenyon’s elder law practice focuses on the needs of the elderly
and we work with a variety of tools and techniques to meet the goals
and objectives of the older client.
Our services include:
- Counseling clients about planning for disability and incapacity
- Preparing alternative decision making documents including
durable general powers of attorney, living wills, wills and trusts
- Assisting the client in planning for possible long-term
care needs including locating the appropriate type of care, coordinating
private and public resources to finance the cost of care and working
to ensure the client’s right to care
- Medicaid: Protecting the client’s assets from the
cost of nursing home or other long term care; assuring security
for the client’s spouse and providing a legacy for his or
her children, guiding clients through the Medicaid application and
qualification process
- Guardianship: Assisting a family member in becoming guardian
of the person and property of a loved one and ensuring that the
loved one will be secure and cared for; ensuring that guardian remains
in control of decisions relating to the care of the person and property
of his or her loved one
- Special Needs Trusts: Advising clients with regard to
the preparation, administration and when required, litigation, of
trusts designed to preserve a disabled person’s eligibility
for public assistance benefits (e.g. Medicaid, SSI and other programs
for the disabled)
